Welcome to Echo Nettoyage! The terms "we", "us" and "our" refer to Echo Nettoyage. Echo Nettoyage operates this store and website, including all related information, content, features, tools, products and services, in order to provide you with a curated shopping experience (the "Services"). Echo Nettoyage uses Shopify Inc., Shopify Commerce Singapore Pte. Ltd or Shopify International Limited, depending on its place of establishment, to provide the Services.

The terms below, together with the policies they refer to (the "Terms of Service"), describe your rights and responsibilities when you use the Services. Please read them carefully: they contain important information about your rights, including disclaimers of warranties and limitations of liability.

By visiting, interacting with or using the Services, you agree to these Terms of Service and our privacy policy. If you do not agree, you must not use or access the Services. These Terms do not limit any rights you have under applicable consumer protection laws or any other legal rights that cannot be waived.

1. Access and account

By agreeing to these Terms, you represent that you have reached the age of majority in your state or province of residence and that you have consented to any minors in your care using the Services on devices you own, purchase or manage. To use the Services, including to browse our store or purchase our products or services, you may be asked to provide certain information, such as your email address and billing, payment and shipping details. You represent and warrant that this information is accurate, current and complete and that you have all necessary rights to provide it. You are solely responsible for the security of your credentials and for all activity on your account. You may not transfer, sell or assign your account or license its use to anyone else.

2. Our products

We strive to present our products and services accurately in our online stores. However, their colours or appearance may differ from what you see on screen depending on your device and its settings. We do not guarantee that the appearance or quality of the products or services purchased will meet your expectations or be identical to their online presentation. Product descriptions may be changed at any time, without notice and at our sole discretion. We may stop offering a product at any time and limit, on a case-by-case basis, the quantities offered to any person, geographic region or territory.

3. Orders

When you place an order, you are making an offer to purchase and authorise us and our payment providers to charge your chosen payment method for the total amount of your order. Echo Nettoyage may accept or decline your order for any reason, at its discretion and subject to applicable law. The order is accepted only once confirmed by Echo Nettoyage. We must receive and process your payment before accepting the order. Check your order carefully before submitting it: we may not be able to accept a cancellation request once it has been accepted. If we decline, change or cancel an order, we may try to notify you using the email address, billing address or phone number provided with the order. Your purchases may be returned or exchanged only in accordance with our return and refund policy, without limiting your legal rights. You represent and warrant that your purchases are for your personal or household use and not for commercial resale or export.

4. Prices and billing

Prices, discounts and promotions may change without notice. The price charged is the one in force when the order is placed, as shown in your confirmation email. Unless expressly stated otherwise, displayed prices do not include taxes, shipping, handling, customs or import charges. Online prices may differ from those in physical stores or in online or other stores operated by third parties. We may offer promotions subject to separate terms that affect pricing. In the event of a conflict, the terms of the promotion prevail. You agree to provide accurate, complete and up-to-date purchase, payment and account information, and to promptly update your details, including your email address, card numbers and expiry dates, so that transactions can be completed and we can contact you. You represent and warrant that: (1) you are authorised to use the payment method provided; (2) the related information is true, accurate and complete; (3) its provider will honour the charges incurred; (4) you will pay the amounts at the prices displayed, including shipping, handling and applicable taxes, if any.

5. Shipping and delivery

Unless otherwise stated, we are not responsible for shipping and delivery delays. Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs formalities or events beyond our control. To the fullest extent permitted by applicable law, title and risk of loss pass to you when we hand the products to the carrier, unless otherwise required by law. We are not responsible for delays or failures caused by events reasonably beyond our control, including carrier or customs delays, natural disasters, severe weather, labour disputes, shortages, utility or telecommunications outages, IT incidents, government actions or similar events. 6. Intellectual property

Our Services, including trademarks, trade names, text, images, graphics, product reviews, videos and audio content, belong to Echo Nettoyage, its affiliates or licensors and are protected by US and foreign trademark, copyright and intellectual property laws. Product pages are also managed and owned by Echo Nettoyage. The purchase or delivery of a product does not grant you any intellectual property rights, including patents, copyrights, trademarks or other proprietary rights in the product, its design, its software or underlying technology. These rights remain exclusively with Echo Nettoyage or their original owner. These Terms only permit personal, non-commercial use of the Services. Without our prior written consent, you may not reproduce, distribute, modify, create derivative works of, publicly display or perform, republish, download, store or transmit content from the Services. Unless expressly provided, no licence or right in any patent, trademark, copyright or other intellectual property of Echo Nettoyage, Shopify or any third party is granted to you. Any unauthorised use may violate applicable law. Echo Nettoyage reserves all rights not expressly granted. Echo Nettoyage's names, logos, product and service names, designs and slogans are trademarks of Echo Nettoyage or its affiliates or licensors. You may not use them without Echo Nettoyage's prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other marks appearing on the Services are the trademarks of their respective owners.

7. Optional tools

The Services may give access to tools provided by third parties, which we do not monitor and over which we have no control or input. You acknowledge and agree that such access is provided "as is" and "as available", without any warranty, representation, condition or endorsement of any kind. We accept no liability arising from or relating to your use of optional third-party tools. Their use is entirely at your own choice and risk; make sure you know and accept the terms of the providers concerned. We may in future offer new features, including new tools and resources. These will form part of the Services and be subject to these Terms.

8. Third-party links

The Services may contain content and links to sites provided or operated by third parties, including embedded third-party features. We are not responsible for reviewing or evaluating the content or accuracy of any third-party content or sites you choose to access. If you leave the Services to access them, you do so at your own risk. We are not responsible for any harm relating to your access to such sites or to the purchase or use of their products, services, resources or content. Review their policies and practices carefully and make sure you understand them before any transaction. Complaints, claims, concerns or questions about third-party products and services should be directed to the third party concerned.

9. Relationship with Shopify

Echo Nettoyage uses Shopify to provide the Services. When you use them, your device communicates with Shopify's systems. Section 10 explains how Shopify uses and processes the information from these interactions. However, sales and purchases made in our store are concluded directly with Echo Nettoyage. You acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Echo Nettoyage, including any injury, damage or loss resulting from the products and services purchased. You expressly release Shopify and its affiliates from all claims, damages and liabilities relating to your purchases and transactions with Echo Nettoyage.

10. Privacy policy

Our privacy policy explains how we may collect, use and disclose certain personal data relating to your use of the Services. By using them, you acknowledge that you have read this policy. As the Services are hosted by Shopify, Shopify collects, uses, processes and stores personal data about your access and use, including your transactions, when you view or interact with the Services. 11. Contributions

If you submit, upload, post, email or transmit ideas, suggestions, comments, reviews, proposals, plans or other content ("Contributions"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display them in any medium and for any purpose, including commercial purposes. We may in particular exercise these rights to operate, provide, evaluate, enhance, improve and promote the Services and to perform our obligations and exercise our rights under these Terms. You represent and warrant that: (1) you own the Contributions or hold all necessary rights; (2) you have disclosed any compensation or incentive received in connection with their submission; (3) they will comply with these Terms. We are not required to keep them confidential, pay for them or respond to them. We may, but are not obliged to, monitor, edit or remove Contributions that we consider, at our sole discretion, unlawful, offensive, threatening, defamatory, pornographic, obscene, otherwise objectionable or in breach of any third party's intellectual property rights or these Terms. You agree that your Contributions will not infringe any third-party rights, including copyright, trademark, privacy, personality or other personal or proprietary rights. They must not contain defamatory, unlawful, abusive or obscene material, or any virus or malware that could affect the Services or any related site. You may not use a false email address, impersonate anyone or mislead us or third parties about their origin. You are solely responsible for your Contributions and their accuracy. We accept no liability for Contributions posted by you or third parties.

12. Errors, inaccuracies and omissions

The Services may contain typographical errors, inaccuracies or omissions, including in descriptions, prices, promotions, offers, shipping charges, transit times and availability. We may correct them, change or update information, or cancel orders if information is inaccurate, even after submission. If we cancel an order after payment, we will issue any refund required by applicable law.

13. Prohibited uses

13.1 You may access and use the Services only for lawful purposes. You must not, directly or indirectly: (a) use them for unlawful or malicious purposes; (b) violate any international, federal, provincial or state regulation, rule or law, or any local ordinance; (c) infringe our intellectual property rights or those of third parties; (d) harass, abuse, insult, harm, defame, disparage or intimidate our employees or any other person; (e) transmit false or misleading information; (f) send, knowingly receive, upload, download, use or reuse any content that does not comply with these Terms; (g) transmit or cause to be transmitted any advertising or promotional material, including junk mail, chain letters, spam or similar solicitations; (h) impersonate or attempt to impersonate any person or entity; (i) engage in any conduct that restricts or prevents others' use or enjoyment of the Services or which, in our view, may harm Echo Nettoyage, Shopify or their users or expose them to liability.

13.2 You also agree not to: (a) upload or transmit viruses or malicious code that could affect the operation of the Services; (b) reproduce, duplicate, copy, scrape, sell, resell or exploit any part of the Services; (c) collect or track the personal data of others; (d) carry out spamming, phishing, pharming or pretexting on the Services; (e) use robots, crawlers, scrapers, data extraction tools, automated devices or processes, artificial intelligence tools such as agentic AI, or any automated or manual means to access the Services; (f) interfere with, circumvent or bypass security, authorisation, robot exclusion or other access-restriction measures. We may suspend, disable or terminate your account at any time without notice if we believe you have breached these Terms.

14. Agents

14.1 This section ("Agent Terms") applies if you use, authorise, enable or cause the deployment of an Agent to access, use or interact with the Services. An "Agent" is software or a service acting autonomously or semi-autonomously on behalf of or at the direction of a person or entity, which may run on a person's behalf or through their device without direct supervision.

14.2 No Agent may access, use or interact with the Services without continuously identifying itself and strictly complying with section 14.4. Nor may any Agent do so if we have asked it to refrain.

14.3 We may restrict, including by technical measures, Agents' access to, interactions with and use of the Services.

14.4 Agents must: (a) state in all HTTP/HTTPS requests that they come from an Agent and give its name in the user-agent string in the form "Agent/[agent name]"; (b) not conceal or disguise their access, use or interaction, in particular by imitating human behaviour or by completing or bypassing CAPTCHAs or other mechanisms that distinguish computers from humans; (c) answer honestly any question aimed at determining whether interactions come from a human or a computer; (d) not circumvent or bypass any measure designed to block, limit, modify or control their access, use or interaction with the Services.

15. Termination

We may terminate this agreement or your access to the Services, in whole or in part, at our sole discretion, at any time and without notice. You remain liable for amounts due up to and including the termination date. The following sections survive termination: Intellectual property, Contributions, Termination, Disclaimer of warranties, Limitation of liability, Indemnification, Severability, Waiver and entire agreement, Assignment, Governing law, Privacy policy and any other provision which by its nature should survive termination.

16. Disclaimer of warranties

Information presented on or through the Services is provided for general information only. We do not guarantee its accuracy, completeness or usefulness. Any reliance you place on it is strictly at your own risk. We disclaim all liability arising from reliance on such content by you, any other visitor or anyone informed of its content.

UNLESS EXPRESSLY STATED BY ECHO NETTOYAGE, THE SERVICES AND ALL PRODUCTS OFFERED ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY REPRESENTATION, WARRANTY OR CONDITION, EXPRESS OR IMPLIED, INCLUDING OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR PROHIBIT SUCH EXCLUSIONS, SO THEY MAY NOT APPLY TO YOU.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ECHO NETTOYAGE, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS AND LICENSORS, AND THOSE OF SHOPIFY AND ITS AFFILIATES, SHALL IN NO EVENT BE LIABLE FOR ANY INJURY, LOSS, CLAIM OR DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, REVENUE, SAVINGS OR DATA, REPLACEMENT COSTS OR SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THEM, OR ANY OTHER CLAIM RELATED TO SUCH USE, INCLUDING ERRORS OR OMISSIONS IN ANY CONTENT OR DAMAGE RESULTING FROM THE USE OF THE SERVICES, CONTENT OR PRODUCTS POSTED, TRANSMITTED OR MADE AVAILABLE THROUGH THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY. NOTHING EXCLUDES OR LIMITS ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

18. Indemnification

You agree to indemnify, defend and hold harmless Echo Nettoyage, Shopify and our affiliates, partners, officers, directors, employees, agents, contractors and licensors from any loss, damage, liability or claim, including reasonable legal fees, owed to a third party arising from: (1) your breach of these Terms or the documents they refer to; (2) your violation of any law or the rights of a third party; (3) your access to and use of the Services. We will notify you of any claim that may be subject to indemnification; any delay in notification will not relieve you of your obligations unless you are materially prejudiced. We may control the defence and settlement at your expense, including choosing counsel, but will not enter into any settlement imposing non-monetary obligations on you without your consent, which may not be unreasonably withheld. You will cooperate in the defence, including by providing relevant documents.

19. Severability

If any provision is held unlawful, void or unenforceable, it will remain enforceable to the fullest extent permitted by law and the unenforceable part will be deemed severed from these Terms. This will not affect the validity or enforceability of the remaining provisions. Nothing limits your rights under consumer protection laws or other laws that cannot be contractually waived. In the event of a conflict, those rights prevail.

20. Waiver and entire agreement

Failure to exercise or enforce any right or provision does not constitute a waiver. These Terms and any policies or operating rules posted on this site or relating to the Services constitute the entire agreement between you and us and govern your use of the Services. They supersede any prior or contemporaneous agreements, communications and proposals, written or oral, including previous versions of the Terms. Any ambiguity in interpretation shall not be construed against the drafting party.

21. Assignment

You may not delegate, transfer or assign this agreement or your rights or obligations without our prior written consent. Any attempt to do so will be void. We may transfer, assign or delegate these Terms and our rights and obligations without your consent or notice.

22. Governing law

These Terms are governed by the laws of the jurisdiction where Echo Nettoyage has its registered office or is incorporated, without regard to conflict-of-law rules. You and Echo Nettoyage agree to the jurisdiction of the courts of that jurisdiction, unless prohibited by applicable law, as well as their territorial and personal jurisdiction. This section does not limit your right to bring proceedings before your local courts or to rely on the mandatory rules applicable where you live.

23. Language

These Terms of Service are drawn up in French. If they are translated into one or more other languages, only the French version is authoritative in the event of any inconsistency or dispute.

Headings are provided for convenience only and do not limit or modify these Terms.

25. Electronic communications

By using the Services or placing an order, you agree to receive electronic communications relating to transactions and the Services, including by email, notification in your account or posting on the Services. They may concern your orders, your account, your purchases, returns, these Terms or other matters relating to the Services. You are responsible for keeping your contact details up to date.
